1. Acceptance of Terms

Welcome to SocialResidency. By accessing or using our platform, website, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and SocialResidency ("we," "us," or "our"). We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

2. Eligibility

To use SocialResidency, you must:

  • Be at least 18 years old, or the age of majority in your jurisdiction
  • Be a verified resident of a participating apartment community or an authorized property manager
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

3. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Your account is subject to approval by your property management. We reserve the right to refuse, suspend, or terminate accounts at our discretion.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, bully, or intimidate other users
  • Post spam, advertisements, or unauthorized promotional materials
  • Share false or misleading information
  • Violate the privacy of other residents
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means to access the Service without permission
  • Violate any applicable local, state, national, or international law

5. User Content

You retain ownership of content you post on SocialResidency ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the Service.

You represent and warrant that:

  • You own or have the right to post your User Content
  • Your User Content does not violate these Terms or any applicable law
  • Your User Content does not infringe any third party's intellectual property or privacy rights

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful or inappropriate.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

7. Amenity Bookings and Payments

Some amenities may require booking and/or payment. By making a booking or payment, you agree to:

  • Provide accurate payment information
  • Pay all applicable fees and charges
  • Comply with the specific rules and guidelines for each amenity
  • Accept the cancellation and refund policies as displayed at the time of booking

Payment processing is handled by third-party payment processors (currently Stripe). Your use of payment services is subject to their terms and privacy policies.

8. Maintenance Requests

SocialResidency facilitates communication between residents and property management for maintenance requests. We are not responsible for:

  • The quality or timeliness of maintenance work performed
  • Any damages or issues arising from maintenance work
  • Property management decisions regarding maintenance requests

Maintenance services are provided by your property management, not by SocialResidency.

9. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by SocialResidency and are protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALRESIDENCY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless SocialResidency and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You remain liable for any obligations incurred prior to termination
  • Provisions that by their nature should survive termination will survive

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Seattle, Washington, unless otherwise agreed by the parties.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against SocialResidency.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in King County, Washington.

16. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and SocialResidency regarding the Service.
  • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
